Who Determines the Custody Schedule?

In Missouri, the custody schedule is typically determined through one of these methods:

  1. Parents’ agreement: If parents can agree on a custody arrangement, they can create their own schedule. This is often the preferred method as it allows for flexibility and cooperation.
  2. Mediation: If parents cannot agree, they may use a mediator to help them reach a mutually acceptable arrangement.
  3. Court decision: If parents cannot agree even with mediation, a judge will make the final decision on custody and visitation schedules.

When a court determines the custody schedule, it bases its decision on the best interests of the child. Factors considered include:

  • The child’s relationship with each parent
  • Each parent’s ability to provide for the child’s needs
  • The child’s adjustment to home, school, and community
  • The mental and physical health of all parties involved
  • The wishes of the child, if they are old enough to express a preference

In Missouri, courts generally favor joint custody arrangements, when possible, to ensure the child maintains a relationship with both parents.
