Does Divorce have to be Filed in the Same State as the Marriage?

In Missouri, divorce does not necessarily have to be filed in the same state where the marriage took place. The key factor is the residency requirement, which varies from state to state.

In Missouri, at least one of the spouses must have been a resident of the state for at least 90 days immediately preceding the filing of the divorce petition. This residency requirement must be met in the county where the divorce is being filed.

So, for example, if a couple got married in another state but has been living in Missouri for at least 90 days, they can file for divorce in the county where they reside, regardless of where the marriage took place.
